Stanley v. City of Sanford

Ruling: The Americans with Disabilities Act, 42 U.S.C. §§12101 et. seq., prohibits most employers from discriminating against disabled individuals who are otherwise qualified to perform the essential functions of the job they either have or else desire to have. 42 U.S.C. §12112(a) and §12111(8). In this case, the Court ruled, 7-2, that the Act does not prohibit discrimination against the disability retirement benefits extended to former employees. Justices Jackson and Sotomayor dissented, arguing that the broader purpose of the Act was to prohibit all forms of discrimination against disabled employees, including disabled retirees.
